§ 1 Coverage and provider

The general terms and conditions apply to all orders initiated by individuals in the online store of American Homestyles owned by Wolfgang Reuter, Reinerzaustraße 20, 77773 Schenkenzell, in the following called American Homestyles.

§ 2 Conclusion of the contract

§ 2.1 The presentation of products in our online store gives you the opportunity to issue an offer to buy. By clicking the purchase button you are making a binding bid. The selling of our products normally serves private use in household quantities.

§ 2.2 We accept an order by sending a confirmation e-mail or with the shipment of the ordered merchandise within five days. The automatic confirmation of receipt of your order does not represent an acceptance of the bid.

§ 2.3 Should our confirmation of the order contain typing or printing errors or should our prices be based on technical-related residual errors, we are authorised to refutation. In this case we will have to proof our error. Already transferred payments will be immediately refunded.

§ 3 Prices

The prices shown on the product pages include German value added tax at the current valid rate and are exclusive of postage or freight charges.

§ 4 Shipping costs

§ 4.1 For delivery within Germany we are charging 5,90 EUR per order, for oversized parcels as used for chairs and rockers we are charging 29,90 Euro.

For deliveries outside Germany we charge:

The shipping costs for oversized parcels as used for chairs, rockers and tables to the above mentioned countries are inquired for by individual postal ZIP code at our logistics partner. We will inform you about those individually and you can then decide whether you want to confirm your order or not.

§ 5 Terms of delivery

§ 5.1 We are delivering within Germany, to the European Union and to Switzerland and Norway.

§ 5.2 Your order leaves our warehouse about 3-5 working days after receipt of the order unless there is other information given in the online store. Chairs and tables, which are ordered with additional finishing will be delivered within 12 – 14 days.

§ 5.3 If ordered products are not in stock, we are entitled to partial delivery at our expense as far as this is reasonable to you.

§ 5.4 Should the delivery of goods to your ship-to address fail after three attempts, we are allowed to resign from the contract. Payments that have been made will be immediately refunded.

§ 6 Terms of payment

§ 6.1 Orders can be paid for through prepayment after receipt of invoice, credit card or (German domestic orders only) cash on delivery. Domestic customers of American Homestyles can from the second order on choose payment after receipt of invoice as payment method (Germany only). We reserve the right to exclude certain methods of payment.

§ 6.2 If you are choosing prepayment, we will send you our banking details with the acceptance of your order. If you are choosing puchase on account we will send the invoice together with the goods. The invoice amount has to be transferred to our account within 10 days. If you are choosing credit card in the online store, your card will automatically be charged after you finalized your purchase. Credit card orders that are received over the phone or fax: the card will be charged on the day of shipment of the order.

§ 6.3 If your payment is not received within 10 days of receipt of the goods we are entitled to charge you default interests amounting to 5% above the basic rate of interest. Moreover we reserve the right to prove higher damages and charge the costs incurred.

§ 6.4 You can only assert a right of retention if the requirements are resulting from the same contractual relationship.

§ 6.5 A right of compensation is only available to you if your counter performance is legally recognised, indisputable or conformed by us in writing.

§ 7 Reservation of proprietary rights

We own the goods until they are paid in full. Before transfer of ownership, pledging, transfer by way of security, converting or deformation are not allowed without our agreement.
 

§ 8 Cancellation policy
§ 8.1 Right of withdrawal
Customers are allowed to withdraw their declaration of contract within two weeks without any specification of reasons in writing (e.g. letter, fax, e-mail) or by sending back the goods. The two weeks’ period starts with the delivery of goods together with a detailed cancellation policy in writing. To meet the deadline of cancellation, the timely dispatch of the cancellation or the goods is sufficient. Our cancellation must be addressed to:

§8.2 Consequences of cancellation
In the case of cancellation, the mutually received payments, goods or services have to be returned. 

You have to bear costs of return if the delivered goods are in accordance with the ordered products and if the price of the returned good does not exceed 40 Euro or in case of a higher price, the good has not already been paid completely or in parts. Goods that can not be sent as parcel will be collected. Payments have to be returned within 30 days. The deadline starts with your despatch of your cancellation request or the item in question; for us it starts with our receipt of the same.

Please try to send back the goods in their original packaging with all of its elements and use a protective outer package. In case you do not have the original packaging any more, please assure sufficient protection against damages in transit with dequate package.


§ 8.3 Your right to cancel a contract and return goods to us does not apply to products and services that have been specifically custom made for you.

§ 8.4 Please return your parcel as an insured package and keep the post office receipt as proof of shipping.

§ 8.5 When returning goods we kindly ask you to contact us beforehand by phoning ++49-7836-336 to inform us about merchandise being returned. Your information will help you and us to return and receive the goods in a fast and trouble free manner.

§ 8.6 Paragraphs § 8.3 to 8.5 are not legally required to return goods in accordance with German laws.

§ 9 Damages in transit

§ 9.1 If goods are delivered with obvious transport damages, please directly complain about the defect to your postman and please establish contact to us by telephone +49 (0) 7836-336 as quickly as possible.

§ 9.2 Failure to file a complaint or contacting us has no consequences for your implied warranty based on German legislation. However, it will help us lodge our claim against the forwarding company and/ or freight insurance.

§ 10 Warranty

§10.1 Warranty is based on current European legislation.

§ 11 Liability

We are excluding liability for minor infringements of duty, as far as these are no fundamental duties of the contract, damages resulting from infraction of life, body or health as well as guarantees or requirements of the Product Liability Act. The same applies for infringements caused by our employees.

§ 12 Final provisions

§ 12.1 The contract incidentally remains valid, if a requirement of these general terms and conditions should be invalid. The appropriate legal requirements are replacing the invalid condition.

§ 12.2 German Law is essential.
